Like-Kind 1031 Exchanges

1031 Exchange Explained

As outlined by the IRS, a 1031 exchange is a “like-kind” property exchange that gives you the ability to defer capital gains taxes on sales of investment property. This is an appealing option for investors to postpone tax payments on their asset’s growth and instead invest the gains into a new, similar investment property.

You will have 45 days from your closing date to identify a like-kind property and deliver a written description of your intent to the seller of the potential new property — or an intermediary individual. In addition, you will have 180 days from your closing date to complete the exchange.

What Does NOT Qualify for 1031 Exchanges?

Unfortunately, homeowners who do not use their home for business use (e.g., renting it out) do not qualify. Other types of non-real-estate assets do not qualify for like-kind exchanges:

  • ^Stocks
  • ^Bonds
  • ^Securities or Debt
  • ^Partnership Interests
  • ^Certificates of Trust
